Fold – Terms of Service (TOS)

Welcome to Fold. We (“Fold”, “we”, “our”, or “us”) hope you find the platform useful. By accessing or interacting with our website, mobile application (“App”), servers, or any associated services, listings, or content (collectively, “Fold”), you agree to these Terms of Service (“TOS”). Fold is a privately operated platform owned by Fold, Inc.

If you are using Fold on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to this TOS. If you do not agree to the TOS, you are not authorized to use Fold or download the App.

We may modify the TOS at any time, at our sole discretion. You are responsible for reviewing updates. Continued use of Fold constitutes acceptance of the revised TOS. Our Privacy Policy, Prohibited Items/Content Policy, and any other rules or policies referenced on Fold are incorporated into this TOS.


1. LICENSE

Subject to your compliance with the TOS and (1) being of legal age and capacity to use Fold, or (2) binding a business entity to the TOS, we grant you a limited, revocable, non-exclusive, non-transferable license to use Fold.

You agree not to display, frame, copy, distribute, license, or sell content from Fold without our express written consent, except for content you post.
By posting content on Fold, you grant us a perpetual, irrevocable, worldwide, fully paid, sublicensable license to use, copy, display, distribute, and create derivative works from your content.


2. USE OF FOLD

Unless expressly authorized by us in writing, you agree not to:

  • Use or provide software or services that interact with Fold (other than general-purpose browsing/email tools).

  • Scrape, crawl, harvest, copy, or extract data or content from Fold.

  • Misuse or interfere with Fold’s systems, moderation tools, security, or user accounts.

  • Post misleading, unlawful, harmful, fraudulent, or prohibited content.

  • Create, buy, or sell Fold accounts.

  • Collect information about Fold users without their explicit consent.

  • Circumvent Fold’s moderation actions, technical protections, or access controls.

  • Reverse engineer, decompile, or modify the App or any Fold software.

  • Use Fold in any way that violates federal, state, or local laws, including but not limited to homestead-related regulations, livestock sales requirements, animal health certifications, transport laws, or food-byproduct regulations.

Livestock, Animal Products, and Regulated Goods

Fold is a listing platform only.
Transactions happen off-platform and between buyers and sellers directly.

You acknowledge and agree that:

  • Fold does not broker transactions, handle goods, or certify seller claims.

  • Fold does not verify compliance with federal or state laws regarding animals, raw milk, eggs, meat, or other regulated products.

  • Users are 100% responsible for ensuring their own compliance with USDA, state agricultural departments, raw milk laws, transport regulations, and all other relevant legal requirements.

  • Fold is not responsible for the legality, quality, safety, or condition of any goods or animals listed.


3. PROHIBITED CONTENT

You agree not to post or attempt to post prohibited content, including but not limited to:

  • Illegal items or services

  • Animals or goods restricted by federal/state law

  • Misrepresented animals (health, lineage, vaccinations, etc.)

  • Items violating USDA, FDA, or state agricultural rules

  • Fraudulent, misleading, harmful, or deceptive listings

  • Spam, scams, or mass advertising

  • Harassment, hate speech, or unsafe content

  • Data-collecting posts, phishing, or identity misuse

Fold may moderate, remove, block, re-categorize, delay, or restrict content or accounts at our discretion. Nothing we say or do limits our right to moderate (or not).


4. FEES

Certain listings or features may require paid fees.
By submitting a paid posting, you authorize us to charge your account.

  • All fees are non-refundable, including for moderated or removed posts.

  • Taxes may apply.

We reserve the right to reject any posting.


5. DISCLAIMER & LIMITATION OF LIABILITY

To the full extent permitted by law, Fold and its officers, employees, agents, contractors, licensors, and affiliates (“Fold Entities”):

  1. Make no warranties or representations about Fold, including availability, accuracy, completeness, reliability, or security.

  2. Provide Fold “AS IS” and “AS AVAILABLE.”

  3. Disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

  4. Are not responsible for the actions, omissions, listings, goods, animals, communications, or conduct of users.

Fold Entities are not liable for any direct, indirect, incidental, consequential, or special damages, including loss of profits, data, goodwill, or personal/property damage related to Fold or any transaction that occurs through Fold.

In no event shall our total liability exceed $100 or the total amount you paid us in the previous 12 months, whichever is greater.

Some jurisdictions limit such disclaimers; portions may not apply to you.


6. CLAIMS & INDEMNITY

All claims, disputes, or causes of action (“Claims”) arising out of or relating to Fold shall be governed by the laws of the State of Tennessee (or your preferred jurisdiction), except where overridden by federal law.

Claims shall be resolved exclusively in courts located in [Insert City, State], unless we seek injunctive relief elsewhere.

You agree to:

  1. Submit to the personal jurisdiction of these courts.

  2. Indemnify and hold harmless Fold Entities from any third-party Claims arising from your use of Fold or violations of this TOS.

  3. Accept responsibility for any Claims brought against your employees, agents, contractors, or affiliates arising from their use of Fold under your direction or benefit.


7. TRADEMARKS

Fold, the Fold logo, and any other Fold branding are trademarks of Fold, Inc. You may not use them without written permission.


8. MISCELLANEOUS

  • This TOS is the entire agreement between you and Fold.

  • If any term is deemed unenforceable, it shall be modified to the minimum extent necessary to remain enforceable.

  • Fold’s silence or inaction regarding a violation does not waive our rights.

  • The sections on Use, Disclaimer, Liability, and Claims & Indemnity survive termination.

  • The English version of this TOS controls over any translations.

  • If you believe your intellectual property has been infringed, please contact us (a DMCA process can be added if you want).
